Commercial Dispute Between a Supplier and a Distributor

A product distributor engaged Jurisphere after a supplier terminated a distribution agreement mid-term, citing performance grounds that the client disputed. The matter had the potential to proceed to civil litigation, though both parties had expressed interest in a negotiated resolution if feasible.

Jurisphere assessed the agreement and the correspondence history, identified the basis of the client's position, and advised on the merits and risks of the available paths — mediation, arbitration under the AIAC rules, or litigation. After review, both parties agreed to engage in structured mediation facilitated by Jurisphere's counsel.

A settlement was reached at mediation, preserving the business relationship in a modified form and avoiding the time and cost of litigation.
